How Worker’s Comp Insurance Affects the Ability to File Wrongful Death Lawsuits
If the employee that suffered an accidental death while on the job was covered under worker's comp insurance, the employee's beneficiaries or surviving family members cannot sue for wrongful death, however, they may have legal rights to compensation for emotional damages or physical harm suffered if the employer was negligent in some way that cause or contributed to the death. (Ferriter v. Daniel O'Connell's Sons, Inc., 381 Mass. 507, 413 N.E.2d 690 (1980).)
If the employee's accidental death was due to the negligent actions of a third party, Massachusetts worker’s compensation statute does provide rights to surviving dependents to file a wrongful death lawsuit against the third party even if the employee had workmen’s compensation through his employer.
